Alternative Dispute Resolution and Arbitration

With increasing regularity, disputes arising under commercial or employment contracts are subject to mandatory arbitration or mediation clauses.  These alternative forums for dispute resolution often provide a more efficient and cost-effective means of resolving a dispute. And our clients regularly turn to us to represent them in such matters.  We have prosecuted and defended commercial arbitrations before private tribunals such as the AAA and the ICC, as well as securities arbitrations before FINRA and the New York Stock Exchange. 

A representative sample of our recent caseload includes:  

  • The successful expungement of a customer complaint against a securities broker-dealer before FINRA. 

  • A UNICTRAL (United Nations Commission on International Trade Law) arbitration in which we obtained a pre-award attachment of assets and, ultimately, a large financial reward for a client pursuant to a put-option contract under Ecuadorian law.  

  • Successful prosecution, on behalf of a Swiss group, of complex securities fraud claims in arbitration against a major U.S. financial institution, resulting in a large arbitration award for our clients.

  • Successful prosecution of breach of contract claims in arbitration against a major European petroleum producer.
