Firm Wins Appeal in Dispute over Funding of a Brazilian Telecommunications Company

The Firm’s client, a Delaware LLC, owns Brazilian telecommunications assets.  When a member of the Delaware LLC defaulted on its funding obligations, the Firm filed an action for breach.  The defendant raised a host of defenses and sought dismissal of the action.  On appeal from the trial court’s denial of the defendant’s dismissal motion, the Appellate Division, First Department, affirmed and permitted the case to proceed.  Litigation partners Zeb Landsman and Jesse Conan represent the client; Mr. Conan argued the appeal in the Appellate Division and the dismissal motion in the trial court.
